PAIA Manual

This manual is published in terms of section 51 of the Promotion of Access to Information Act, 2000 (PAIA) for UnityStack (Pty) Ltd, trading as UnityProp. It explains what records we hold, how to request access to them, and how personal information is processed on the platform.

1. About this manual

This manual has been prepared in terms of section 51 of PAIA for UnityStack (Pty) Ltd, trading as UnityProp, a private body. PAIA gives effect to the constitutional right of access to information held by another person that is required for the exercise or protection of any right. This manual also contains the information required by section 51(1)(c) of PAIA, read with the Protection of Personal Information Act, 2013 (POPIA).

3. The Regulator’s guide

The Information Regulator has compiled a guide in terms of section 10 of PAIA that explains, in plain language, how to use the Act. The guide is available in all official languages from the Information Regulator’s website (inforegulator.org.za) and from its offices.

4. Records held by UnityStack (Pty) Ltd

We hold records in the following categories:

  • Company and statutory records (incorporation documents, registers, resolutions)
  • Financial and tax records (accounts, invoices, banking, tax returns)
  • Contracts with clients and suppliers, including service agreements with schemes
  • Marketing and correspondence records (website enquiries, support communications)
  • Platform operational records (system logs, configuration, security and audit records)

Records held on behalf of schemes: personal information of residents, staff and visitors processed in the platform is held on behalf of the relevant body corporate, homeowners association or managing agent (“the scheme”) as its operator. The scheme is the responsible party for those records under POPIA. Requests for access to those records should be directed to the relevant scheme. Where we receive such a request, we will refer it to the scheme and assist the scheme in responding.

5. How to request access

  • Complete the prescribed Form 2 (Request for Access to Record of Private Body), available from the Information Regulator’s website (inforegulator.org.za).
  • Send the completed form to our Information Officer at info@unityprop.co.za.
  • Identify the record you need, state which right you seek to exercise or protect and why the record is required for that purpose, and provide proof of identity (and of authority, if you request on behalf of someone else).
  • Fees are charged in accordance with the PAIA regulations. A request fee may be payable before the request is processed, and an access fee may be payable for search, preparation and reproduction. We will advise you of any fee before proceeding.
  • We will respond within 30 days of receiving a complete request. This period may be extended once by up to 30 days in the circumstances permitted by PAIA, and we will notify you if that happens.

6. Grounds of refusal and remedies

We may refuse access to a record on the grounds set out in Part 3, Chapter 4 of PAIA, for example to protect the privacy of a third party, commercial information of a third party or of UnityStack (Pty) Ltd, confidential information, the safety of individuals, or legally privileged records. If a request is refused, we will give written reasons.

If you are not satisfied with our decision, you may lodge a complaint with the Information Regulator, and may thereafter apply to a court, in the manner and within the time limits set out in PAIA and its regulations.

7. Processing of personal information (section 51(1)(c))

7.1 Purposes of processing

We process personal information to create and manage user accounts and role-based access, to link users to the correct building and unit, to provide the platform’s features (announcements, issue reporting, resident and visitor management, communications), to respond to support requests, to secure the platform and keep audit logs, and to comply with legal obligations. The full list appears in section 5 of our Privacy Policy.

7.2 Categories of data subjects and information

Data subjects include owners and landlords, building administrators and managing agents, residents and other authorised occupants, building staff, visitors, and visitors to our website and support channels. The categories of personal information we process are set out in section 4 of our Privacy Policy.

7.3 Recipients of personal information

Personal information may be shared, on a need-to-know basis, with authorised users within the data subject’s own scheme, and with service providers acting as operators in the following categories: hosting and infrastructure, messaging delivery, and error monitoring. We do not sell personal information.

7.4 Cross-border transfers

Some processing by our hosting, messaging and error-monitoring providers takes place outside South Africa. Transfers take place under written agreements that impose data protection obligations substantially similar to POPIA, as permitted by section 72(1)(a) of POPIA.

7.5 Security measures

We apply reasonable technical and organisational measures to protect personal information, including role-based access controls, least-privilege permissions, encryption in transit, monitoring and logging, and secure development practices, and we require our operators to apply appropriate safeguards.
